Our experts in plant safety conduct inspections in the area of water protection (handling of substances hazardous to water – AwSV) and act as authorized experts in accordance with § 29a BImSchG. These activities include, for example, the review of technical documentation such as safety reports pursuant to § 9 of the Major Accidents Ordinance (StörfallV), explosion protection documents, as well as commissioning inspections and recurring inspections of safety-relevant systems or components in accordance with the Operational Safety Ordinance (BetrSichV) and the Federal Immission Control Act (BImSchG).

Our Expertise in Plant safety

Baseline condition (AZB)

According to the Federal Immission Control Act (BImSchG), facilities subject to the EU Directive 2010/75/EU on industrial and agricultural emissions (IED) must submit a Baseline Report (AZB) on soil and groundwater conditions as part of the application documents for new permits or substantial modifications.

The AZB documents the condition of the soil and groundwater on the facility site at the time of commissioning and ultimately serves as evidence and a reference point for the obligation to restore the site upon decommissioning. A comprehensive AZB must be submitted whenever relevant hazardous substances (rgS) are used, produced, or released on the facility site and if contamination of soil or groundwater by these substances is possible (§ 10 paragraph 1a BImSchG).

We offer the following services related to the AZB:

  • Preliminary assessment to determine whether a full AZB is necessary (“AZB pre-check”)
  • Development of investigation concepts, if measurements are needed to determine baseline conditions
  • Coordination of required investigations in close consultation with the responsible authority and other stakeholders
  • Preparation of the full AZB
  • Development of monitoring concepts for soil and groundwater in accordance with § 21 para. 2a no. 3c of the 9th BImSchV

Expert assessment under major accident legislation

As part of assessments regarding the applicability of the Major Accidents Ordinance (12th BImSchV), we first determine whether and which requirements of the Twelfth Ordinance to the Federal Immission Control Act (12. BImSchV, Major Accidents Ordinance) must be fulfilled by the operator.

Where necessary, we offer the following services in particular:

  • Determination and evaluation of appropriate safety distances or precautionary distances in accordance with Guideline KAS-18 in conjunction with § 50 BImSchG
  • Preparation of expert opinions within the scope of technical planning for the construction of sensitive uses/objects within the appropriate safety distance according to KAS-18 (weighing of interests)
  • Preparation/review of concepts (according to § 8 of the Major Accidents Ordinance)
  • Preparation/review of safety reports (according to § 9 of the Major Accidents Ordinance)
  • Preparation of risk analyses, e.g., using the PAAG method
  • Calculation and assessment of substance releases due to disturbances using recognized models (e.g., VDI 3783, ProNuSs)
  • Preparation of alarm and hazard prevention plans (according to § 10 of the Major Accidents Ordinance)
  • Public information (according to § 11 of the Major Accidents Ordinance)

Expert assessment in explosion protection

Explosion protection encompasses measures and precautions to prevent explosions in hazardous areas. This includes the identification and assessment of potential explosion risks, the implementation of technical and organizational protective measures, and compliance with legal requirements and standards. The goal is to ensure the safety of people, facilities, and the environment.

Müller-BBM Industry Solutions GmbH supports you in evaluating the hazard potential of your existing or planned installations in accordance with the Industrial Safety Ordinance (BetrSichV) and the Hazardous Substances Ordinance (GefStoffV), and in implementing safety measures that reflect the current state of the art.

We offer the following services in particular:

  • Preparation of explosion protection concepts based on planning documents and explosion protection reports for existing installations, in accordance with § 6 (9) of the Hazardous Substances Ordinance (GefStoffV)
  • Review and updating of existing explosion protection documents

Fire prevention

We prepare fire protection concepts for you as a fundamental requirement for the design and approval planning of your construction project. In doing so, we take into account not only regulatory requirements but also your design preferences and the intended future use of the building. For ongoing operations, we draft fire safety regulations and fire department plans, as well as the complete technical fire protection documentation. Our service offering is rounded off by insurance-related risk analyses and expert opinions.

 

Inspection service in explosion protection

According to the German Ordinance on Industrial Safety and Health (BetrSichV), employers must ensure that inspection-required installations are examined for operational safety prior to initial commissioning, after any modifications requiring inspection, and at regular intervals. These inspections must be carried out and documented by a qualified person as defined in Annex 2, Section 3 of the BetrSichV.

We offer the following inspection services:

  • Inspection of installations in potentially explosive atmospheres after modifications requiring inspection, to verify explosion safety in accordance with § 15 BetrSichV in conjunction with Annex 2, Section 3
  • Recurring inspections of installations in potentially explosive atmospheres in accordance with § 16 (1) BetrSichV in conjunction with Annex 2, Section 3

Hazardous substance classification

The classification, assessment, and labeling of substances and mixtures place significant demands on operators and manufacturers. A legally compliant classification of hazardous substances not only ensures legal certainty but also contributes to a safe working environment. Moreover, accurate classification of handled mixtures or residual substances—such as the non-Seveso-relevant classification of combustion residues—can save operators considerable costs.

We support you in the classification of hazardous substances, particularly with the following services:

  • Classification of mixtures and preparations, especially residual mixtures (e.g., waste disposal), in accordance with Regulation (EC) No. 1272/2008 (CLP/GHS Regulation)
  • Preparation of safety data sheets (SDS) in accordance with Annex II of Regulation No. 1907/2006 (REACH)
  • Classification of transport goods according to Dangerous Goods Regulations for sea, rail, and road transport
  • Creation of hazardous substance registers

Assessment in Water Protection under AwSV

Facilities for Handling Water-Hazardous Substances (AwSV Facilities) are subject to specific requirements under the AwSV, particularly depending on their hazard level and the type of water-hazardous substances being handled.

The AwSV experts of the Müller-BBM AwSV Expert Organization, recognized under §52 AwSV, support you in identifying all requirements applicable to your AwSV facility and advise you on their implementation.

We offer the following services in particular:

  • Consulting during the approval process of facilities
  • Consulting during execution and construction
  • Preparation of expert reports under §41 AwSV (exemption from the requirement for suitability determination)
  • Preparation of expert reports under §42 AwSV (suitability determination) upon request by the competent authority
  • Development of AwSV concepts (e.g., in the context of remediation projects)

Inspection services in water protection under AwSV

Facilities for Handling Water-Hazardous Substances (AwSV Facilities) are subject to certain inspection dates and intervals depending on their hazard level, location, and the water-hazardous substances handled within them, in accordance with Annex 5 or Annex 6 of the AwSV.

The AwSV experts of the Müller-BBM AwSV Expert Organization, in accordance with §52 AwSV, carry out the following inspections of your AwSV facilities:

  • Commissioning inspections
  • Recurring inspections
  • Inspections after significant modifications
  • Decommissioning inspections

Inspection service under major accident legislation

As part of assessments regarding the applicability of the Major Accidents Ordinance (12th BImSchV), we first determine whether and which requirements of the Twelfth Ordinance to the Federal Immission Control Act (12. BImSchV) must be fulfilled by the operator.
