State of the art

The term 'state of the art' stands for the state of development of advanced processes, installations or operating methods which shall ensure the practical suitability of a measure for limiting emissions into the air, water and soil, for ensuring the safety of installations, for ensuring environmentally sound waste disposal, or otherwise for preventing or reducing impacts on the environment, with a view to achieving a generally high level of protection for the environment as a whole. When determining the state of the art, particular account must be taken of the criteria set out in Section 3(6) of the Federal Immission Control Act (BImSchG).
